Jap Warlords' Appeal To Supreme Court Opens

VIOLATION OF THE AMERICAN

CONSTITUTION ARGUED

Washington, Dec. 16.-The attorney for seven Japanese war criminals today asked the Supreme Court to review their conviction by the International Tribunal. The hearing was limited by the high Court to the issue of its jurisdiction to look into the.

casps.

William Logan, Jr, representing the Japanese war- lords, was interrupted frequently by questions from the bench as he maintained that the Far East Tribunal was "strictly an American creation."

Mr Logan said establishment of the Tribunal by General MacArthur was illegal usurpation of the powers of the executive branch, and the military.

The Solicitor-General, Mr Philip Perlman, contended

con- that the victed Japanese war criminals were not governed by and had no standing to assert rights under the constitu tion and laws of the United Sintes, Counsel for the Japanese con- of crime tended the prosecution against "peace and humanity" re- tronctively violated the United States constitution.

He said that the Tribunal was an international undertaking. He said that once it is suggested that, the Courts can American

Dec. 15, The Supreme Court was bombarded to- ciny with arguments for and against Mr Periman argued that General Ite Intervention in the case of seven MacArthur ncted for the Allied Japanese warlords convicted of wor powers in concert. LETTER OF AUTHORITY

Mr Periman introduced a feller, written on December 4 by the Acting Secretary of Stato, Mr Robert Lovett,

in

which Mr Lovett outlined the authority, both from the US, and from the 11-nation Far Eastern Com- 2* mission, under which General Mac- Arthur established. the Far Eastern Tribunal and affirmed the sentences passed.

Mr Lovett had written: "The- Department of State regards the International Military Tribunal for the Far East as an International court appointed and acting under international authority."

Mr Perlman said that since thin under the petitioners were held judgment of the International cou'd Tribunal no national court review the judgment or any action It is taken to carry out judgment. expected the hearings will conclude on Friday and the Court will meet Saturday in its weekly secret con- ference at which time the case presumably will be discussed and decided. The earliest announcement of the decision will be Monday If there is no announcement then. none is expected until January 3.

GOVERNMENT'S WARNING:

"

The Justices acknowledged in statements from the Bench that it posed a difficult problem. Tho Judges questioned Mr Wililai Logon, defence attorney, closely on his claim that General MacArthur beyond his authority in establishing the Far East court to

The Chief Justice, Mr Fred, Vin- son, pointed out that it was on 11-nation Tribunal. Mr Logan said there was "no other court to which we can go,”

Mr Vinson: "May there not be

Mr Justice Frankfurter Interrupted Mr Logan at another point to ob- serve: "Something may be illegal and yet international and so be something over which this court has. no jurisdiction".
