THE HONGKONG TELEGRAPH, FRIDAY, JULY 23, 1948.

Mr B. A. Bernacchi, Instructed by Mr Y. H. Chan (Ts'o and Hodgson) appeared for the plaintiff, and Mr

A. Lonsdale (Acting Solicitor- General) was for the defendant.

Dealing with the right of the Governor to dismiss Cowie, Mr Lonsdale said that the deferice was. In fact, a plea of res judicats (on Isue that has been settled in court).

Ho submitted that a proper Boardi of Enquiry had been duly set up by the Commissioner of Police, and it had forwarded its recommendations on the charge or charges under its consideration to the Governor who, exercising his powers, dismissed the plaintiff on the basis of the finding of the Board of Enquiry that Cowic was guilty of misconduct.

GOVERNOR'S ENTITLEMENT

Counsel submilled that there was

.nobody better able 10 body judge a police officer than a constituted of his fellow officers.

There was a difference between the present proceedings and criminal procee proceedings because there was no penalty as a penalty in the present Instance. Mr Lonsdale declared. Inst There was merely a power under Section 10 of the Police Force Or- dinance for the Governor to do what he was entitled to do under the terms of the plaintiff's contract to terminate it.

Counsel submitted that the fact

that a Board of Enquiry had been held estopped the plaintiff from say- ing that he was wrongfully dismiss- ed. It was necessary for the plain- tiff to first take proceedings to quash the finding of the Board of Enquiry by a writ. of certiorari, he said.

The case is proceeding.
