These shortly are the facts the question I have to determine is whether, in these circumstances, Plaintif Is-entitled to claim his money back.

Now, it is common ground that, ps a general rule; a person is entitled to recover on a total failure of the consideration, but where the money has been paid for an entire con- sideration and there is only a partiul failure of such consideration nelther the whole nor, any part of such sun can be recovered. Thus where a Plaintiff apprenticed fils son to n watchmaker and jeweller for the term of six years, paying to the master a premium of £25, and the master died after having given only one year's instruction, it was held on an action brought to recover the whole or part of such premium on the ground of failure of considera- tion that the failure, being only partial, the action was not main- tainable,

A Distinction

On the other hand, however, there is a distinction between a fallure of part of the consideration, and a partial failure of the con- sideration, it having been held that failure of part of an entire con- sideration is a failure of the whole consideration Unless part perform- ance has been accepted, in which case it becomes a partial failure of the whole consideration.

Having carefully reviewed the evidenca given, I have no hesitation in saying that I accept Defendant's version of the whole transaction as the correct one, and I do not. accept Plaintiff's statement that the under- standing between them was for an unlimited course of instruction. I am satisfed that Defendant taught Plaintiff to the best of his akill and knowledge, and the fact that his pupil failed on two occasions to satisfy the examiners was not, in my opinion, due to lack of tuition but to Plaintiff's nervousticss and Inck of self-control. Plaintiff him- zelf admits that he was nervous when undergoing the tests, and I fail to see how any person, be he n tufor of motor-car driving, cab- driving or even rickshaw pulling, can be expected to include a cure for nervousness in his curriculum.

On the facts. ne proved to my satisfaction, therefore, I hold that there has been not over a partial fallure of consideration, since I am Betised that Defendant performed his undertaking to the best of his ability and skill.

There will therefore be judgment for the Defendant with costa,
