Tenant Seeks Protection Of Ordinance

-Contests Landlord's Notice To Quit `·

Protection of the Prevention of the Evictions Ordinance was evoked by Lam Pak-suen before. Mr. Justice E. H. Williams at the Summary Court this morn- ing when a possession claim was Instituted against him by Clian Fo-po.

Onus On Defendant

Mr. Zimmern said that the claim was for possession and meane profits in respect of 54 Nga Tain Wal Roud, Arst floor, Kowloon City. Certaini facts have been agreed and the only question in dispute was whether or not the defendant was a tenant of the premises before June 3, 1938. That being so, the onus was on the defence to establish that fact.

Mr. McCallum said he accepted the position that the onus was on him in for that he was claiming the pro- (ection of the Prevention of Evictions Ordinance.

Zimmern sald he disputed the alleged fact that the defendant was In possession of the premises is 1937. Mr. McCallum said that a, written notice to quit the premises had been received and in reply to that he had written to Mr. Zimmern and this letter act out exactly what the posl- tion was as regards the defendant. The second paragraph of the letter pointed out that the defendont and his wife and sister-in-low arranged to take the premises and they moved in on August 6, 1937.
