The president, Sir Boyd Merriman, said that in spite a of Mrs. Wilmer's deception of the Court he did not feel justified in rescinding the decree.

"This marriage," he continued, "has never been a marriage in any sense of the word, and there is not the slightest chance of it ever becoming one when this man comes out from the long term of benal servitude to which ho has been sentenced.

The King's Proctor had intervened lo show cause why the decree nisi granted to Maws. Wilmer, of Cheyna How, Chelsen, on the ground of the adultery of her hsuband should not be mndo absolute.

Wilmer, who in January last year was sentenced to five years' penal servitude, did not defend the petition. In granting the decrce, Mr. Justice Henn Collina had exercised his dis- cretion in Mrs. Wilmer's favour in respect of ndultery which she ad- mitted with Mr. Patrick Henry Noel Gamble.

The King's Proctor now alleged that Mrs. Wilmer had presented a false case, as she did not fully dis- close her own adultery, and bad condoned her husband's adultery by living with him as his wife at Henley-on-Thaines.

She again asked the Court to exercise its discretion, but denied the King's Proctor's allegation of con- donation.
