Old Legal Ruling

A Hongkong legal ruling establish- ed 25 years ago in connection with money loan assciations was quoted during the hearing of a claim far 56 in the Summary Court yesterday, before Mr. Justico Lindsell.

The claim was brought by Ip Sze, of d'Aguilar Street, on behalf of himself and all other members of the Leo Pun Ching Money Loan Association, against Cheung Ngau, of Cochrane Street, and was for $6, soing the monthly contribution pay- able by defendant as a drawn mem- ber.

For the plaintiff, Mr. P. M. Hodgson sald the Association was started in and .ovember by. Los Pun-ching conalsted of himself and 11 other members, including Ip and defendant, Cheung drew his share in February. but, following the death of the head in July, refused to pay his con- tribullon at the August.. meeting, whore pialatif drew his share. De- fondant's ground for refusal to pay was that the head having died, the Association had ceased to exist.

Mr. Hodgson submitted that the fact that the head had either abscond. ed or died was immaterial and, in upport, quoted a ruling to this effect by the Inte Mr. Justice Gompertz.
