FLOGGING TO

TO END

IN THE NAVY

Request Made By Admiralty

The Admiralty, has asked the Government to abolish fogging in the Navy.

This was announced by Sir Terence O'Connor, the Solicitor-General, when a Standing Committee of the louse of Commons again considered the Government's Criminal Justice Bill recently.

Sir Terence moved an amendment, which was passed, applying to the Navy the section of the bill proposing to abolish corporal punishment. It was not necessary, he said, to do this In the case of the Army and the Air Force, because flogging did not apply there.

Sir Archibald

Southby (Cans., Epsom), a former naval officer asked when the Admiralty's request reach ed the Home Ofee and why the Committee was not told of it when they were discussing the abolishing Blogging.

clause

Sir Terence said the Admiralty expressed their view some time ngo, but it did not seem proper to try to Influence the decision of the Com- mlitee simply because the Board of Admiralty had taken that view,

Sections applying the proposal to abolish penal servitude, hard labour and prison divisions to the Navy were also agreed to.

Sir Terence said the clause was one of the most important in the bill.

" goes a long way," he added, "to answer a good deal of the argu- ment against the abolition of flogging. We are now leaving the law without any sanction against the hardened criminal. This clause is in effect the sunction which is going to be operated in many of the eases which have defled any treatment previously Lex- cept that of the Inh."

̈DEMANDS FOR INQUIRY Sir Terence submitted an amend

to redraft the clause giving ment courts power to make reception or- ders against persons of unsound mind. Two medical practitioners would now be required not merely to give certi- Bentes, but to give evidence in court on the grounds from which they formed their opinion.

The amendment and a clause giving power to order remand for Inquiry into a person's mental condition weru agreed to.

"PROTECT

SOCIETY"

The problem of the persistent offen- der was discussed on the clause pro- posing corrective training for offen ders between 21 and 30 and preven tive detention for offenders over 30. The bill provides that the sentence in such cases should be not less than two years and not more than fir

years.

Mr. R. 1. Turton (Cons.. Thirsk and Malton) moved an amendment to give courts power to impose sentences up to 10 years' preventive detention for certain offences such rape.

Mr. Rhys Davies (Soc., Westhough- ton) objected to the idea that offen- ders should be "clapped into prison and left there to rot."

Sir Terence O'Connor, resisting the amendment, said he doubted whether the totalitarian regimes had anything quite so formidable as Mr. Turton proposed.

Str. William Wayland (Cons., Can- terbury): The Committee burn their boats behind them when they abolished corporal puntaliment, which would be a very effective punishment for the cases which Mr. Turton mentioned. Although I do not like the German code, I would certainly

POSTPONEMENT ASKED FOR

Mr. Mork Morrison, counsel for the defence, asked for two weeks' post- ponement before the hearing of the cate, she received no instructions and had no knowledge of the case.

Furthermore it was "very compll-

eated."

Mr. Wallace Kemp, prosecuting officer, sald he was prepared to carry on, as he had all his witnesses and the exhibits in court.
