"Where the tenant falls to deliver possession. the landlord in entitled to re-enter and take possess inn, subject only to certain statutory re-enter restrictions. Thus he can where the tenant has abandoned can effect possession or where he forcibly, and is thus liable to criminal entry peacefully; and even if he enter proceedings under the statutes, yet the tenoni has no civil remedy against him in respect of the re-entry, or In respect of the eviction, if no more force than is necessary in used."

NO COMPULSORY EVICTION

The amendment, therefore, will prevent compulsory evictions, and if compulsory eviction is attempted the tenant will be enabled to cotain an injunction and damages.

Government will also have the power in future to stop rent racketeering. In future, Courts will have the power to determine any

rent question relating to payable or to be paid by a sliting tenant.

Unscrupulous landlords who, wish- in to get rid of a tenant, forget to collect rents or avoid receipt of rentg and then exercise their power of distress under the Distress for Rent Ordinance, will no longer be able to get rid of an unwanted tenant in that Inshlon.

Under the new amendment, the landlord will have to satisfy the Courts that a tenant is unwilling to pay the rent demanded, or that the rent is not excessive, before a warrant need be issued.
