Claims Wages For Patriotic Campaign

Further evidence In the claim for remuneration of $818,33 against the Hon. Sir Shouson Chew, Mr. Kan of Tong-po, manager of the Bank Eust Asta, Mr. Li Sing-kui, Chairman of the Chinese Chember of Com- J. Chen, merce, and Mr. Shou Manager of the Bank of China, brought by Mr. Francis Yee, was heard before Mr. Justice R. E. Lind- sell at the Summary Court this morning.

The claim against the four defen- dants, who were stated to have been delegated by the Chinese Govern- ment to take charge of the sold of Salvation Bonds in Hongkong, is in connection with the advertising cam- paign for the bonds.

The plaintiff was represented by Mr. M. A. da Silva, while Mr. Peter H. Sin appeared for Sir- Shouson Chow and Mr. Shou J. Chen. Mr. C. Y. Kwan was for the other two defendants.

A counter-claim for damages in the sum of $385 was brought by Sir Shouson Chow and Mr. Chen. The elaim is for alleged breach of duty by plaintiff in authorising or procur- ing the printing of 10,000 posters.

Mr. Shou J. Chen continued giving evidence from the previous hearing when he said that the committee had never sanctioned or tried to put up any poster, and that it was definitely decided that they would not make use of posters.

The sub-manager of the Bank of China, Dr. S. F. Lam was then ques- tloned by Mr. Sin, and in reply said that he was not a member of the Bond Committee. No rough sketch of the poster had been shown to him by the plaintiff before the printing, and when the bill arrived for the posters he took the plaintiff to see Mr. Chen who was annoyed about it as he had not approved of the poster.

Kwan who is acting for the second and third defendants, then submitted that there was no case to answer in respect to his own clients, as in the writ his clients were sued personally, and there was nothing either in the title or the endorsement suggesting that his clients were sued In their representative capacity,

After citing from different legal authorities, His Lordship said they might possibly save some time if any other evidence could be brought up after the summing up of Mr. Sin's case had been heard.

SUMS UP CASE

Mr. Sin then summed up his case and said that the defence clearly embodied in letter written by him to Mesars. Deacons, who were acting for plaintiff, on November 27.

The claim on the part of the plaintiff is that he was employed to conduct an advertising compaign in respect of the sale in Hongkong of the Bonds, and that the campaign was terminated on March 31, 1938.

It was agreed that his remunera- tion should be $200 per month as from November 1, 1937, and that he was wrongfully dismissed on Novem- ber 13. To succeed the plaintif must prove conclusively that he was so employed upon the basis alleged by him. The campaign may operate until March 31, 1938, but it does not follow that the plaintiff will be engaged unill then.

An allowance of about $150 a month was hinted by the plaintiff himself, and even on October 18 no specific allowance had been arrived at between him and my clients. The fact thut No arrangement for remuneration had been made can be seen even on the receipts, as plaintiff signed for different amounts as much for allowance, counsel sold.

rely The plaintiff now seeks upon the arrangement made on Octo- ber 26, that his salary should be $200 a month from November 1; the $200 to include pay for his two helpers. If that is true, the plaintiff could be dismissed instantly for his miscon duct.

HAD NO SANCTION

The plaintiff had without sanction or authority exhibited the posters on buses and troms, und It is absolutely clear that without authority he ordered the printing of 10,000 posters and exhibited them, counsel went on.

It was clearly made known to him thint for amounts over $50, permis- sion must first be obtained.

If Mr. Chen had given the order to the plaintiff for the posters he would not havo made such fuse when the printer called for payment. That fact is substantiated by Dr, Lam who was present at the time, counsel submitted,

On the evidence shown, the first and fourth defendants rightly terminated the plaintiff's engagement. Judgment was also asked for the counter-claim, as it had clearly been shown that no permission had been given by Dr. Lam or Mr. Chen, said Mr. Sin.

The case is proceeding.
