CAPACITY OF JUDGES
Part of the problem of obtaining a sufficient number of judges to dis- pose of these cases, is the capacity of the Judges themselves. This brings forward the question of aged or infirm fudges...a subject of delicacy, and yet one which requires frank dis- cussion. In exceptional cases, of like other men, retain course, judges, to an advanced age their full mental and physical vigour.

ROOSEVELT'S PROPOSALS
The President proposed, firstly, that in each instance where a federal Judge reaches the age of 20 and fails to retire, that the President be em- powered to name an additional judge, providing such appointments do not increase the number of Supreme Court Justices above 15, nor 30 for the judiciary as a whole.
Secondly, no Federal Court will be allowed to issue any decision Invol ving constitutional questions, without ample previous notice to the Goven ment, and immediate appeals on all such questions will be allowed to go direct to the Supreme Court, taking precedence over all pending matters. Thirdly, transfers and shifts in IRON DUKE" Federal Judges' districts will be allowed In order to accelerate court business.
