In contradiction, the wife alleges that she will not accept the husband's offer because she is afraid he will allack Her when once she bas turned! The only evidence which is adduced to support such a contention (and it is strongly denied) is that the husband attempted to strike her once after leaving the court and that he Retually strike-her-before shq finally left the marital home. I am very doubtful whether these are the real reasons which prompted the wife to refuse the husband's offer. It seems to me that what is keeping these two parties separate is the presence of another woman in the house, namely the concubine or ping chat. It is the old story of the eternal triangle of two women dc. manding the affections of one man, r as the wife in this case hos 80 quaintly put it. "There cannot bc two moons in one sky."
I do not think that the presence of a concubine in the house can re- but the bona fides of the husband's offer. It is true that in England, Barnes J. said in Sickert v. Slckert, "A wife, whose husband is carrying on adulterous intercourse with an- other woman or other women is not bound to remain in co-habitation with | him," but in view of Chinese custom I do not think that the defendant can to be in this case, be considered carrying on adulterous Intercourse with the concubine. I therefore find that the husband's offer to take back his wife into the marital home is a genuine offer made in good faith and na such constitutes a complete answer to charges alleged. The summons is accordingly dismissed.
