Boston pased out the Pirates in eleven innings, four to three. They each had nine hits and the Pirates had one error.

NO COMPROMISE WITH JAPAN

Melbourne, June 3.

Sir Henry Gullett, chairman of the The solicitor in question was M. A. da Silva, and the case was the Australian Tariffs Commission, to-day one in which Chan Tan-kwai, discussed with the Japanese Consul elder of Tat Tong village, Fing Chau here Tokyo's new counter-proposals island, brought an action against five with respect to the lately revised persons, including three women, of Australian tariffs. The case was heard by Mr. Justice J. J. Hayden, Acting Chief Justice and Mr. W. A. The claim was based on the allega. tion that the first three defendants, on October 4 last year, maliciously and without any reasonable or proper cause preferred a charge, of attempt Ing to obtain money by a faire pre tence, against the plaintiff and

of the same village, other elder Li Wah, before a Magistrate, sitting at Taipo, and caused them to be triesi and imprisoned. The plaintiff sub sequently brought an appeal against the conviction at the Court of Appeal, which quashed the sentence.

The troub, it was disclosed at the previous hearing, arose through the refusal of the plaintif and Li Wah to allow the defentiants to remove and from their village.

SOLICITOR'S DISCOVERY.

The matter which prompted Silva's application was in regard to the date in which the plaintiff was alleged to have committed the offence. Mr. Şiiva said it was he himself who found out, while taking Instructions for an appeal against the conviction, that a client was not in Ping Chau island at the time when the offence was alleged to have taken place.

Jawing his interview with the diplomat, Sir Henry stated that Japanese goods which had been manufactured at a price. so low that it was impossible for any other coun try to compete, could not be allowed to overwhelm the markets of Austra lin.

Australia, he said, looked to the Mother Country and other Dominions of the Empire for an outlet for her products, and would consequently give preference to these British countries. Japan, he added, was a poor cus tomer to Australia in every other
