SALE OF POWER LEGALISED

TENNESSEE VALLEY CASE RULING

VICTORY FOR ROOSEVELT

Washington, Feb. 17. The Supreme Court of the United States has at last ruled in the Tennessee Valley Administration. and has found in favour of the Government.

It found that'sales of surplus power by the Government, from its property at the Wilson Dam, was constitu- tional.

The chief ground on which the Valley authority was challenged was the right of a federal agency to com- pete with private utility Orms in tho sale of electricity-cuter.

LEGALISED SALE

Washington, Feb. 17. The New Deni won the day in the Supreme Court's test case on the Tennessee Valley_Authority,

The Supreme Court approved the sale of

Fenerated by the Wilson power Dam and indiented that it approved the future development and sale of electricity on the Tennessee River.

Chlef Justice Hughes rend the Court's decision in

which

only Justice MeReynolds had dissented.

The decision held that:--

the

(1) The Government n ower to build the Wilson Dam na an aid to navigation;

(2) The

sell sucht has power to

from sach dams;

power produced

(3) The Government has power 10 build transmission lines for the transmission of such power produced to reasonable markels.

In

The Supreme Court's decision ap parently permits similar Federal Power developments on other rivers, Addition Justices Benndela, Roberts and Cardozo expressed the opinion that the stockholders of the Alabama Power Company lacked the right to bring the suit against the TV.A.

The decision does not touch the

right of the Government to finnner rural or municipal power lines or electrical distribution systems, United Presn.

WIDER PROBLEM

Washington, Feb. 17. The TVA decision was not un- animous, the vote of the court being eight to une, Justice McReynolds dis- senting.

The ruling, however, gives no opinion with regard to the validity of the Government's acquisition or operation of local or urban distribu- tion systems. Reuter.

MARKET CRACKS

Washington, Feb. 17. Although the Supreme Court has upheld the T.V.A. În the Alabama stockholders' suit insofar as it applies to the Wilson Dam power, it has not expressed any opinion on the Noris Dam or future TV.A. programmes. The decision merely indientes that the method used by the T.V.A. in the Wilson Dam instance is constitution al, which was the point raised by plaintiffs.
