Sentenced to four years' 'hard labour at the last Criminal Sossions, for breach of a deportation order; Lí Fook-sang successfully brought an appeal for reduction of his sentence before Mr. Justice R. E. Lindsoll and Mr. Justice J. J. Hayden at the Full Court this morning.

Mr. Justice Lindsell, who imposed the sentence at the Inst Sessions, told Mr. Williams that the Court had already taken notice of the fact that, owing to a misunderstanding as to the term for which the prisoner was originally banished, he was in fact wentenced to an illegal term, namely one year more than the maximum which he should have been given. He

was banished for ten years and not for life, and therefore, the maximum sentence that could have been passed on him was only three years. Under the circumstancos, the Court was arenared to deal with the matter as If it was not an appeal, against sen- tence but as an anneal against the illegality of the term of prison- ment,

Mr. Justice Lindsell replied that the Court was only cancerned with the question of sentence,

A BAD RECORD

Mr. Williams stated that the av nellant had a very bad record, as he had been banished no less than four times. The first orcasion was in 1925 for which he received a sentence of two years, the second was in 1930 when he was sentenced to eight months and 15 strokes of the birch, and the third was in 1931 when he received a sentence of three years as well as another two years in connec tion with an armed robbery, The present ecension was the fourth.
