ISLAND ROAD MOTOR SMASH A SEQUEL IN COURT
Lower Court proceedings against Yueng Yim, driver of lorry No. 891, charged with the manslaughter, of Lau Cheuk-so, aged seven years, at Island Road near Ropulse Bay Hotel on January 29, were continued bo- fore Mr. W. Schofield at the Cen tral Magistracy yesterday after
noon.
Lau Chouk-hi, a boy aged ten years, who was one of the pas- sengers in the Fiat car involved in the collision, gave evidence,
Mr. J. A. Fraser, Assistant at- torney General, is conducting the case for the Crown, while Mr. P. H. Sin is for the defence. Mr. F. X. D'Almada, inr, is holding a watch- ing brief on behalf of the doceased's family.
Mr. Bin during the course of the hearing disclosed that his defence would be that the brakes of the Fiat car driven by Hau Cho-shiu, were defective.
Nge Tai-wal, of No.: 111 Portland Street, master of the Kwan On Transport Contracting firm, testi- fled that he was at present employed in transferring building material from the Government Stores, Wan- chal, to the new gaol site at Stanley. He first engaged accused to drive the lorry in November 1933, and re- engaged him about January 21 this year.
Replying to questions by Mr. Sin, witness stated that accured WRE paid $4 per lorry load. Accused. had nothing to do with the loading or unloading.
Driver's Responsibilty
Mr. Schofield: He is responsible for seeing that the load is properly. secured.
Mr. Sin (to witness): It was to your advantage, was it not, to load as much as you could so as to make BB fow Journeys as possible.
Witness: I was not present at loadings. A sub-contractor was in charge, My instructions to him were to load the lorry to the extent of a little over two tons,
Re-examined by Mr. Fraser, wit- nces said that after the lorry was loaded it had nothing to do with him (witness). Of late the londs comprised mostly Iron rods.
Lau Chouk-hl, deposed that he ilved at No. 9 Yuen Yuan. Street, Happy Valley. He remembered go- Ing for a car ride about January 29, In the afternoon. Witness sat in front next to the driver, Hau Cho- shiu. Their original intention was to go to Deep Water Bay, but when they had almost reached their des- tination they decided to turn back and went past Repulse Bay,
"I saw the lorry travelling in the middle of the road. We pulled to the side and sounded our horn," said the witness. "The lorry ran into us. I was fright- ened and did not know what happened afterwards. My head was injured and I was taken to hospital."
Replying to Mr. Sin, witness said he did not hear the horn of the lorry.
After further evidence the hearing was adjourned.
PHILHARMONIC SOCY.
NECESSITY TO EXTEND THE FINANCIAL YEAR
The Hon. Secretary of the Hongkong Philharmonic Society invites the attention of all mem- bers to the fact that under the existing rules the financial year ends on February 28, and the on- nual general meeting, at which the accounts must be passed, and a new Committee elected, must be held not later than April 10. If these dates are not changed, the accounts for the current season must be closed before "Hiawatha" Is produced and other buslacss cannot be arranged in time for the annual meeting.
It is therefore proposed that the current financial year bo ex- tended to March 31, and that the annual general meeting he held not later than April 30.
These proposed changes will be formally submitted at an extraor dinary general moeting called for March 4 in the China Fleet Club Theatre, at 5.30 p.m. It is hoped that members will give their 18- sont to these proposals, and there- by greatly assist the work of the Committee, and especially of the Hon, Treasurer and Hon. Scere- tary,
