Fairburn should-not-have been put to the jury, Mr. Fraser said the point was not raised, as it should have been, at the trial, and it was not competent now for the Court of Criminal Appen to deal with it.

Mr. Lim interposed that if it had been put to the jury in this way: "Was one of the children Michael Pine?" and they had answered "Yes," then the verdict would have been against the weight of the evidence.
