Under te arrangement, the term "merchant" was defined as applying to persons who engaged solely in promoting the oversen trade between Australia and Chinn on a wholesale
basis.
It has been condition, however, that a reasonable substantial anomt of overseus trade should be carried
only the individual merchant, or firm to whom the concession was granted. Australian Born Chinese.
The children' of Chinese born in Australia are permitted to remals in, Australia indefinitely. If they are taken out of the Commonwealth by their parents, no objection le raised to their returning to Australia at any time without restriction. If their true home is in Australia. This is the effect to the judgment of the High Court on this question. Irrespective however, of whether Australin is the actual home of an Australian born Chinese, facilities are given for such jierrons to roturn to Australia within a period of ten years, or longer, in honn fide cases. The main ronson why certain precautions were necessary in cases of this kind was that evidence was found that Australian birth cer- tinentes were being used irregularly. This was the reason for obtaining the Judgment of the High Court,
