Mr. T. P. K. Kemble, appearing for the driver this morning, sub- mitted that there was no doubt that the man's death was caused by the accident, but the medical evidence was that his death was really caused by the load he wAD carrying on his back. Mr. Kemble therefore
submitted that the driver of the car was rather un- lucky. On the point of the in- efficiency of the brakes, Mr.. Kemble submitted that Sorgeant Melnnis had stated that a certain portion of the brakes was dis connected. He submitted this was enused by the bump when the car passed over the man. It was in- credible that defendant would have driven the car with the brakes in the condition mentioned. Mr. Hamilton, floed, defendant $50 on the first count, and cau- tioned him on the second, remark- ing that if it were not for the fact that he was driving at only 15 milen un hour, he might have been held for manslaughter.

RULING IN KOWLOON DOG CASE
S. Komor, of No. 18 Hill Wood Rond, was summoned before Mr. J.H.B. Lee at the Kowloon Magis tracy this morning for allowing his dog to be in a public place without д
muzzle or a lead on July 7 at 7 p.m.
Defendant denied the charge. Ho said the dog had a lead and was being taken out by an amah..
Inspector Shaftain said the facts of the case were rather unusual. It was true that the dog was being led by an amah from a chain. While coming down the steps of the flat, the dog bit somebody who, was going up. The stairs could not be called a public place, because aa unauthorised person found on them at night could be charged with, loitering.
His Worship decided that the stairs were not a public place and dismissed the summons.
Mrs. F. La Fleur, of K.II. 63, Ngau Shi Wan, was. fined $5 on each of three summonses for not having licences for her dogs. It was stated that defendant took out the licences immediately, after the dogs had been found by Sergeant Pennell.
Mrs. J. J. Richard, of No. 44 Buto Street, was fined $8 for not having a licenca for her dog on July 13,
