FIVE FIRMS ACCUSED OF INFRINGEMENT
Five retallers were suminioned before Mr. Hamilton, at the Central Magistracy this morning, for possession of brands of dental eronia bearing trade marks which
were calculated to decaive. The complainants were the Colgate Palmolive Pont Company, of U.S.A.
The defendants were the Chan Yin firm, of No. 16 Fat Hing Street; Leung Sang Kel Arm of No. 125 and 121 Queen's Raud, Central; Shiu Hing Lang firm vf No. 226 Queen's Road, "Central; Chung Cheung firm of No. 194 Queen's Road, Eust; and the Chai Kee firm of No. 1 Kwong Yuen Street, East,
Mr. Hugh Jones appearcil for the prosecution, and Mr. O. E. C. Marion for the Chan Yin firm. The other defendants were not re- presented.
Mr. Marton drew attention to a discrepancy in the wording of summons against his client, that the summons did not describe the trade mark which they were supposed have resembled
Mr. Hugh Jones submitted that
It was not quite necessary specify this on the summons. The defendants were in Court, and the summons could be amended
if Mr. Marton desired it, or a new
summons could be taken out.
Mr. Marton said he thought the correct procedure would be
for the defendant to be dis charged, na the summone was not properly framed; the summons could not be amended.

A sensational development in the Chan Lim-pak case was recorded at the Central Magistracy this morning when Mr. Chan Lim-pak failed to appear.
His bail of $10,000 was estreated and Mr. Hamilton ordered a warrant to be issued for his arrest.
When the case was called, Mr. M. K. Lo, appearing for defendant, said that just before the time was Mr. Hamilton suld he would Į due for him to come to Court, he adjourn the summons at 1135; received a letter from defendant a.m. on Saturday, as that they could argue the matter out if necessary,
The representative of the Leung Sang Ketended that he had bought the goods from two other firms.
He was fined $25 on each of the summonses against him, and also ordered to pay $100 costs.
