FIREMAN GAOLED

AFTERMATH OF GASÓMETER FIRE DISASTER

'Three months' hard labour, was the sentence imposed by Mr. Hamilton, at the Central Magis- tracy yesterday afternoon, on Cheung Kit, a fireman attached to the Central Fire Station, charged with larceny of a quantity of jewellery from No. 8 Clarence Terrace on May 15, after the gasometer fro,

Mr. Hamilton, in convicting de- fendant, remarked that It was only a question of guilty intent, and if defendant had been working at Clarence Tarrace all the while in- stead of going to Chung Shing Street, where ho was ordered by Mr. Brooks, he might have believed his story, but he could not believe that a man with jowellery valued at over $500 could place it in his pecket and forget about it when he was moved and passed Mr. Brooks. If he had worked continuously at Clarence Terrace

no conviction would have been registered.

Addressing Mr. Brooks, Mr. Hamilton said he thought there should be a definite standing order, giving precise Instructions for the conduct of firemen in such cases. Firemen should immediately cense work and hand over valuables re- covered. They should not be al- lowed to touch valuables, and once they touched valuables they should at once report.

Present in Court was Mr Grant, 2. S. P.. Inspector Hourihan, in charge of the case, and Mr. H. T. Brooks, Superintendent of the Cen- tral Fire Station.

The Evidence,

Sergeant Wagland said that at 7. a.m, on May 15 he saw a party of firemen begin work on clearing the debris from No. 8 Clarence Torrace. As they were working, several articles were picked up and passed on to the Police. About 7.40 am, he saw three firemen ordered by Mr. Brooks to Chung Shing Street. They passed Mr. Brooks, himself, two Russian con- atables in uniform and two Chinese constables in uniform, on their way to Chung Shing Street. He did not hear or see any of them make report of jewellery being picked up. About 7.00 am. he had reason to believe that jewellery had been picked up by fireman No. 80 (defendant), and, with Mr. Brooks, lie went to Chung Shing Street in search of the three fremen. The three firemen were searched. Ser- geant Fitches came on the scene in the meantime and witness found in defendants right hand trouser pocket a quantity of jewellery, which he handed over to Sergeant. Fitches. While he was searching the other two firemen, defendant made no attempt to hand over the jewellery

Defendant, in a statement, anid that he found the articles of jewellery and put them into his pocket. He meant to return them to the Superintendent after..he. had finialicd his work. The Superintendent sent him on an other job in Chung Shing Street, and he was searched when going to get some hose. It was true the Articles were found on him, but he had no intention of keeping them, although he had every change of putting them away. CE: was just an oversight on his part, and he did not anticipate being searched. When the other two men were being searched, he was not aware he had the things on him.

Mr. Brooks ndied that defend- ant had been b the Force since August last, was a good worker and had a clenr, record.
