POLICE MIGHT USE DISCRETION
NO HARM IN CERTAIN CASES
Mr. Justice Mackinnon, at Gln- morgan Assizes suggested that the police authorities should exercise greater discretion in bringing higamy cases before the court.
"Bigamy is an offence which varies in seriousness," said the judge. "It used to be regarded as an ecclesiastical matter and, quita properly, the authorities did not want any offence against tho Church; but to-day many сего monios are performed' outside the Church, and although they are. morally wrong there are certain cases in which, apart from the moral standpoint, no real harm has been done to the first, or Becond
woman.
For that reason I suggest that greater discretion might be shown before putting the machinery of the law in motion."
War-time Ceremony
The judge added: "In the case now before the Court, apart al-. together from a technical law point as to the validity of the first marriage, the woman' has gone through a second form of marriage and the other woman in the case ad- mits that the prisoner has been kind to her and that she has no grudge..
"Under those circumstances, why it was necessary, In the public interest. to bring this matter before the court, especially as involved`n waste of public money through three or four witnesses travelling from Ireland, is beyond my comprehension."
The case itself was an unusual one. The accused man, Benjamin |Rice (38), went through a form of marriage with Ethel Wright at Bel- tast. It was a war-time "marri- age," and Rice left for France a day or two after the ceremony.
Mr. Justice MacKinnon said no judge would think of punishing the man.
The jury found Rice not guilty, and he was discharged.
