CHINESE RESTAURANT MORTGAGE CASE Appeal Before the Full Court

The Full Court of Appeal con- sisting of the Chief Justice, Mr. J. R. Wood, Mr. P. Grant Jones, Julgo of the Supreme Court of China, and the Puisne Judge, Mr. R. E. Lindsell, sat at the Supreme Court to-day to hear an appeal against an order made by Chier Justice Wood in Alay of this year.

Appellants were

Au Wing-k Au Wang-yun of 20 Des Voex Road Central, Victorin, and they were represented by Mr. H. G. Sheldon and Mr. Leo D'Almada, jnr., barristers, Instructed by Messrs. Tuo and Hodgson.

Cau Yun-chi, widow, of No. 1. Wood Rd. Victoria, the respondent, was represented by Mr. Eldon Potter, K. C., Mr. F. C. Jenkin, KC, and Mr. H. C. Macnamara, instructed by Messrs. Wou and Nash,

In May of this year, the Chief Justice on the mution of Chu Yun- chi, set aside an order previously granted by him extending the time for registration of a mort- gage and further charge between the Chinese Restaurant. Ltd., on the one side, and Au Wing-ki and Au Wing-yun on the other. To- day's appeal was for the reversal of this setting-naide and for costs, The matter arose from the mortgaging of certain property to hy the Chinese Restaurant Au Wing-ki and Au Wing-yun toTM secure repayment of $350,000 in June of 1928. In June. 1931 the Company further charged their property to the mortgagees to secure $72,500. In onch case no step

in- was taken, through advertence, to conform with the registration of the deeds within the time required by the Compan- les Ordinance, but Messrs. T'so & Hodgson applied for and obtained an order extending the timo for registration. An appli- cation to mat aside this order was successful and it was set aside as a nullity and also as an order ob tained from the Court without the full exhibition of all material facta.

Ninety per cent. of the voters who went to the 'polls recorded support for the Hitler programme. In many cases the queues at the polling-booths were so long that the voters had to wait for hours.

Storm troop brass-bands dashed from booth to booth in motor-lorries entertaining the crowds, and all restaurants and beer-houses did a wonderful business, most of the voters celebrating the occasion.
