HUSBAND SUED

WIFE'S ALLEGED DEBTS TO

LOCAL HOTEL

of Megars:

Mr. A. Wheeler, Thomas Cook and Son, Ltd., Queen's Building, was sued at the Supreme

05

Court yesterday by Mrs. Anna Bellu Oxberry, trading the Palace Hotel, Kowloon, to recover expenses of board, lodging and refreshments amounting to $314.58 alleged to have been incurred by defendant's wife.

Alternatively

claimed plaintiff $314.68 for necessities supplied to defendant's wife who was hell out; to be his agont.

the

The particulars stated that amounts were incurred as follows October $108.99, November $138.00, December $50.00, January $24.10.

Mr. F. H. Loseby, of Messrs, Russ appeared for defendant, and HH. Cole, of Messrs. Geo, K. Mr. Hall Brutton and Co., represented plaintiff.

Following a legal argument as to the form of the statement of claim, Mr. Cole opened the case. He salo that in October of last year Mr. and to the Palace Mrs. Wheeler came Hotel and engaged a room for de fendant's wife. Mr. Goldenberg the licenses, was also the brother of plaintiff and all four parties hau: known each other for a number of yenra.

Husband's Vinita.

anu

Room 19 was engaged for Mrs. Wheeler at the rate of $4 a day in- eluding board. Mrs. Wheeler moved 8, subse- into the room on October

oving into a smaller room. she was at the Hotel her hus-

her visited band frequently sometimes brought the children with him. By this conduct, he submitted, the husband held out his wife na being authorised to pledge his credu for the rooms. Demands were made to the wife and she always said the husband would pay. The bills were sent to him but remained unpaid.

If separation was to be the de- fence, this was an unusual caso bon cause tho separation was unusual. There was no legal separation at all as far as he could understand, add- ed Mr. Cole.

Mr. Loseby objected to his client's family autairs being bronched.

Plaintiff's Evidence.

Mrs. Oxberry gave ovidence bear- ing out her solicitor's statements.

Cross-examined witness said she did not know "exactly" whetner, de- fendant and his wife were separat- ed, but she would not have given Mrs. Wheeler credit had she not been accompanied by her husband, to whom plaintiff looked for payment. She knew Mrs. Wheeler was earn- Ing $60 સી. month but she could not Defendant her pay

way on that. had stayed at the hotel for a fow days three years ago. The wife hau the custody of the children on that occasion.

Mr. Goldenberg gave evidence, and denied that he was mistaken in stat- ing that Mrs. Whoeler was accom. panied by her husband when "the room was booked.
