ASSAULT CHARGE NOT PROVED.

SEQUEL TO AN INCIDENT

AT CATHEDRAL

Pte. Joseph Patrick Hiley of the South Wales Borderers, ap- peared before Mr. Wynne-Jones yesterday afternoon accused of assaulting the No. 1 coolio at St. John's Cathedral. He pleaded not guilty.

On getting up to his feet, he took the torch from witness and searched, for his hat which he found in the complainant's cubicle. Complainant asked wit-j ness to arrest Hiloy who Was the soldier who was seated.

Indian constable B.731 who was on post duty said he was attracted by police whistles. He saw the do- fendant standing in the compound, with a broom. He saw no assault In the barracks compound. Defen- dant refused to be arrested.

Private W. A. Jones, of the South Wales Bordorers, said on the night in question, he arranged to meet

Chinese giri at the bottom of Garden Road. They went for a little walk up Garden Road and on reaching the Cathedrai were told to move away by a Chinese man, who прокс English. He wished her "good-night" and she walked down- bill and he walked towards", the barracks. When ho was about fifteen yards away, the girl was at- tacked by four men. He called to Hiley for assistance to arrest one of the men for assaulting her. Hiley was on military Police duty at the south-east gate of Murray Barracks. In the Cathedral com pound, witness and Hiley wore at- tacked by ten or twelve inen armed with bamboo broom handles. Hiley tried to take hold of one of the men with the intention of handing him' over to the Civil Police, when he was atruck. Neither witness пог Hiley entered the coolie's quarters. Witness had known the girl for eighteen months and this was the firat occasion they had trouble.

Defendant, on oath, said that while struggling with one of the Chinese he was struck by a pole. He tried to explain to the Chinese and Indian constables but on hear- ing the complainant's story they were bent on arresting him. De- fondant stated.-"I did not want to be arrested us it meant taking me away from my duty. Seeing that) the Police were bent on arresting me I walked across Garden Road, and then ran back to barracks, where I reported the matter to the N. C. O. on duty."

Magistrate "I don't know what to make of it all. They are both lying to me. Defendant is lying badly, so is Private Jones, and the complainant and his witness." (To defendant) "You

are lying to cover your leaving your post. You must not think that because you are a regimental policeman you have a free right to arrest. You may go
