Lam Tal-yung, alias Lam Kan, lot B, Gilman's Bazaar, pleaded not gullty to wounding with intent to do grievous bodily harm, Li Kwok Hung, known as Li lung, of 164, Des Voeux Road Central, at the former address on April 22. Mr. R. H. Lim, instructed by Mr H, C. Lee appeared for accused, and. Mr. H. K. Holmes, Crown Solleitor, prosecuted.

Former Friends. Setting out the facts of the case, Mr. Holmes said the three persons chiefly concerned were the accused, the wounded man, and the former's wife, who was the "woman in the case." By this phrase ho did not wish to make insinuations against the woman, but she was involved, and how far she was involved would be a matter for the jury to de- termine.

Li Hung and accused were formerly fokis together in an opium business which was apparently illicit because it was raided at the beginning of this year. The two men remained acquainted' however, after their business relations ceased. Accused, his wife, and a small boy who was related to them, lved in a front cubicleTM at 3, Gilman's Bazaar, and on April 21, the husband returned by the night boat from Macno where he had spent sonte days. Ho visited friends on his arrival in Hongkong and it was not until 3 a.m. that he returned home.

Jealous Husband. According to his own statement, accused discovered Li Hung in bed with his wife, the small boy also being in the cubicle. Li Hang would seek to give an innocent explanation of his presence there and would any that the woman had sent for him because he was going back to the country and she wanted hin to take a message to her mother.

It has been laid down quite recently that the Crown cannot be forced to call any witness. It is not because I don't want the woman to be call ed that I object- have no objec tion to my friend taking any ad- here, vantage of her presence that he could. He can call her himself if he likes.

The Judge: I'hold, Mr. Lim, that the Crown cannot be com- pelled, even on your application, to put the wife into the witness box.
