A search was made. and the motor was found on the second floor covered with sacks.. Defendant stated then that the motor had been sent to him for repair, but he could find no record in the books. On a second return from the Police. Station to the shop, a foki was alleged to have slipped a chit to the defendant referring to a motor having been sent by the Kwong Sang firm, Woosung Street. This was found to be untrue. Defendant stated the pulley of the engine had been sent to be shortend.

After Sergeant O'Donovan had given evidence, Mr. T. Young. alectrical engineer of the China Light and Power was called. He stated the pulleys were made ex- clusively for the motors in ques- tion, and it was not possible to make any alterations to them. A motor could be left on damp ground without any effect on the working. The motors were made for working under such condi- tions.

The hearing was adjourned to April 27.

ASSAULT CASE.

CHARGES WITHDRAWN BY THE COMPLAINANT

Before Mr. Butters at the Kow- Toon Magistracy yesterday, after- noon, the case was withdrawn against Cheung Ngan-ngan who, with another man, not in custody, was alleged to have assaulted an- other Chinese on March 30.

A second charge against Yui Sul-nui was also withdrawn, he his being alleged to have in possession offensive weapons and instruments fit for unlawful pur- pases, to wit, two steel files..

Mr. Horace Lo, appearing for: the complainant, requested that the charge be dropped according to complainant's' wishes, He sub- mitted that the complainant and defendant were business men and there being a possibility that there had been some mistake in. identity, complainant was satisfied that whatever had hap- pened there had been no intention on the part of defendant to do harm. Mr. Lo understood that defendant was willing to be bound over. With regard to the second charge, Mr. Lo said that the Police Officer in charge of the case had an objection to the same course being adopted. The defendant on this charge also was willing to be bound over.

Mr. R. H. C. Lim, instructed by Russ & Co., agreed with Mr. Lo's Buggestions if his client, the de- fendant, was to be bound over without any convi...ion.

The Magistrale in agreeing to Mr. Lo's request, o'dered both de- fendants should enter, into a ro cognisance of* $250 each to be of good behaviour for the next twelve months.
