CLAIM FOR WAGES ADVERTISING SALESMAN AND VERBAL CONTRACT
Ilarry Arthur Love, an advertising salesman, of 4n., Hankow Road, Aue- cessfully claimed for wagen and commission due to him from the and Advertising United Publicity Company, Ltd., of Asiatle Building, nt the
Supreme Court yesterday afternoon, before the Puigne Judge (Mr. Justice Wood).
Plaintiff claimed from the Jofen- dants the sum of $516.10, being as to $105 CBrned by plaintiff from September 15 to October 5, 1932, ut $150 a month under verbal contract minde between plaintiff and the United Publicity and Advertising Co.; the sum of $131.10 commission due to the plaintiff on business in- troduced by him either to the defen dants or to their predecessora in business; $140, one month's wages in lieu of notice, the plaintiff having wrongfully been dismissed on Octo- her 5 and $130 further damages for wrongful dismissal, being the es timated amount of commission which the plaintiff would have earned had he received from the defendants one month's notice to which he was en- titled.
Mr. G. 8. Ford (Maasrs. Wilkin- for the son and Grint) appeared plaintiff and Mr. P. H. Sin (Mensra. A. E. Hall) for the defendants.
Terms of Contract.
In evidence, plaintiff stated that ho was engaged by the United Pub- Hicity and Advertising Co. about September 13 last by a Mr. Hellvig, The terms of the then manager. contract, which
verbal was that his salary was to be $150 a per month and commission at 10

cent. on contracta secured. He was dismissed on October 5 by a Mr. Cheng, then manager. On that date ho asked for his salary for Septem ber but it was refused him, Mr. under Cheng stating that he was Amisapprehension as to the terms agreed. A different outline of salary und commission had been worked out and he was to work under that out- line. Witness refused to work un- der the пси terms. During his period of employment he had brought in contracts worth $171 and $1,140 respectively.
Answering Mr. Sin, witness agreed there was no written contract. was taken on at three months pro- Iation to be terminated by mth's notice on either side.

Mr. A. B. Hamson, service muna ger of Mesura, Wallace Harper, gave evidence of introducing plaintiff to Mr. Hellvig and the terme agreed to Advertising Contracts Cancelled. ut the time.
Chong Shi-man, employee of the defondant firm, stated he was fer- merly employed as acting manager of the United Publicity and Adver tising Company, and when the busi- news was transferred to the United Publicity and Advertising Co. Ltd., he was employed by the new com- pany. He was not present when the contract was made with plain Liff, but the terms were tohl hím by Mr. Hellvig. In October when plain- tiff demunded his salary and com- mission he refused to pay him, stating that it was the rule of the company that no commission would be paid until the money was received for the contracts. The two advertis ing contracts had been canesited.
that Mr. Wallace Harper stated the advertising contracts were enter el into by him, and when the busi ness was transferred he notified the firms of his intention of cancelling the contracts. Plaintiff told him when he secured the contracts that he was on trial.
Mr. Sin contended that there was no contract of service between plain- tiff and the defendants, but his Lord- ship stated the pinintia's uvidence had not been contradleted. "I think that by your own act you deprived the plaintiff of this commission, re
it does not matter when the commin. sion was payable," he added.

Bing Crosby, air ece, with Stuart Erwin and Leila Hyams. screen players, head the cast of the production. Kate Smith, the Bon well Sister, the Milla Brothers, Cub Calloway and his Orchestra, Vincent Lopez and his Orchestra, Burna and Allen, and Arthur Tracy (The Street Singer) head the radio cast. Tho picture does not depend for its effectiveness on the mere presente of names, however.
A definite plot holds it together. It has to do with Crosby's affair with Sharon Lynne, which he takes so seriously that ho never gets to the studlo in time to broadcast. Ho loses his job, much to the diamay not only of himself, but of. Mina Hyams, who is rather too fond of him. But his dismay is even greater when Miss Lynne misrries a broker, leaving him flatt At this point he meets Erwin, who is also and-first because Miss Hiyama hasi adandoned him: second because a "dame from Dallaa" has taken him for $100,000. But when he finds that Mian Hyams is infatuated with Crosby, he spends his remaining 3000.00 buring the station and network to restore Bing to his job and make Leiin happy. Thin leads to further amusing consequences which are straightened by means of a big broadcast in which all the stars participato.

Action, thrilla, sustained suspense, believeable romance and story in- terest combine to make "Air Mail" a departure from the ordinary run of movie fare. It is something to see.
