FIRM FRAUD CASE DISCUSSION

POWER OF ATTORNEY

WANTED

The production of a power of Attorney was the subject of much legal argument when the case against Chan Sik-nin tame up be fore Mr. Schofield on remand at the Central Polico Court to-day.

The accused is charged with having forged and uttered a power of attorney and with it to have taken control and management of the King Fook Wo firm of 60, Bonham Strand East. He A accused also of having defrauded the firm of property and monies to the extent of $130,000.

Inatructed by Mr. Peter Sin on behalf of the prosecution, Mr. Hin Shing Lo naking for the modifica Llan of a previous direction, re quested that he be permitted full access to certain documents in a ace in the presence of the police, but not necessarily inspecting them together with Mr. F. Further, Mr. Lo called for the production of a power of attorney with which the accused claimed to have been equipped, arguing that the charges in themselves were Aufficient notice for production.

On the other hand, if the Court ruled against him. ho now gave notice, holding that this was sumetent in criminal procedure.

Properly involved in the case Is said to be at Hanoi, French Indo-China. and much legal argument that followed related to the fixing of a date for the hear ing.

Mr. Schofield said the question could be washed out because he had no available day this week for the hearing

His Worship formally adjourned the case for a week, by the end of which time he intimated that he expected to be informed as to when the prosecution was pre- pared to proceed with hearing.

A formal notice for the pro- duction of the power of attorney was accepted by Mr. Dlmada, whether it was to be substantiated later "orally, by letter or by telephone."

OF POSSESSION In a raid carried out by a party of police at 22, Pokfulam Road on Saturday morning, four Chinese were arrested on a charge of be- ing in possession of an automatic revolver which was loaded with Bine rounds. As a sequel, the mun were brought before Mr. Kennedy Skipton at the Central Police Court, when three were dis- charged and the other pleaded guilty.

Detective Sergeant D. Fitches informed his Worship that the revolver was found on a bed on which the four men had been ly Ing. It Was under the first defendant (the man who pleaded guilty) and uppeared to have been discarded by him when the palice entered.

The police had information that the revolver had been used to demand money and intimidate people, while one of the men pointed out two ballet murks on a wall at the rear where the weapon had been tested in preparation to ita being used in some unlawful undertaking.

The first defendant was remand- ed for 48 hours for further equir- ies into his character, while other three were discharged.
