“SQUEEZE" CASE SEQUEL.

REVISION OF SENTENCE SOUGHT.

The "aqueezo" epse in Yaumati. In which three costables and two hawkers were involved had a Roquel at the Kowloon Magistracy before Mr. Fraser yesterday when Mr. G. K. Hall Brutton applied for a rovision of the aentences of six months and four months pass- ed on two of the constables.

Mr. R. E. Lindsell, the Public Prosecutor,

appeared for thei Crown.

It will be recalled that two hawkers, Chau Pang and Wong Tok, were charged with offering bribes, and the three constablea

Lam, Mnk iu and Wan Pul, were charged with making illegal exactions from hawkers, and with misconduct as Police constables.

Mr. Horace Lo then appeared on behalf of the first defendant. Chau Pang and Mr. F. X. d'Almada, Sr., for the three con- stables.

Eventually. the second die- fendant, Wong Tok, and Mak Ju. the fourth defendant, were dis- charged. The first and third de- fendants were sentenced to Aix months' hard inbour each and the 9fth defendunt, who had

been commended before for meritorious conduct, to four monthe.

Cases Not the Same.

In making his application, Mr. Hall Brution said the charges against the hawkers and the con- stahlen were totally different and The cases should not have been Inken together. If the hawkers) and the constables had not been charged together, some of the evidence against them would have been struck out at once as hear- Any evidence. His Worship, however, pointed out that the defendants were re- presented when the

menced and no objection was then taken.

With regard to Chau Pang. Mr. Hall Brutton submitted that no evidence had been given of "the person or persons unknown." He quoted the case of the Crown Thompson, in which three men were charged with conspiracy with

persona unknown. No evidence was given as to who the persons unknowa were, and two of the defendants were acquitted. as a result of which the third man had also to be acquitted. Mr. Hall Bruton submitted that this was a parallel case.

"Charges Badly Framed." Another ground on which his application was based, went on Mr. Hall Bruttoa, was that the charges were badly framed. That was only a technical point, but if the charges were badly drawn. the defendants could not be made to suffer for the mistakes of the Crown. The Crown mast suller for its own mistakes.

Referring to conspiracy, Mr. Hall Brutton said conspiracy could not have been proved if the two cases had been taken separate ly as they should have been. To support a charge of conspiracy, there must be a criminal act, and Mr. Hall Button submitted that there was no eriminal net committed by the constables. The bare fact that they went up to hawkers to ask for their licences criminal.

In the House of Commons Lo- day, Captain Eden, answering Mr. Geoffrey Mander (Nat. Liberal, Wolverhampton E.) sald that the question of the non-fortification of Hongkong in the event of brenches of the Washington Trenty, and of the Pact of Paris being broken, was sub julier.
