"SQUEEZE” CASE SEQUEL.

REVISION OF SENTENCE SOUGHT.

The "squeeze" case in Yuumati In which three conatables and two hawkers were involved had a Aoquel at the Kowloon Magistracy before Mr. Fraser yesterday when Mr. G. K. Hall Brutton applied for a revision of the sentences of six months and four months pass ed on two of the constables.

It win he recalled that two kawkers, Chau Pang and Wong Tok, wore charged with offering bribes, and the three constables Li Lam, Mak lu and Wan Pui. were charged with making illegal exactions from hawkers, and with mlsconduct as Police constables.

Mr. Horace Lo then appeared on behalf of the first defendant, Chau Pank and Mr. F. X. d'Almada, Sr., for the thron Atables.

Eventually, the second che- fendant, Wour Tok, and Mak fu, the fourth defendant, were dis charged. The first and third de- fundants were sentenced to six months' hard labour curh and the Afth defendant, who had brez commended before for meritorious endurt, to four months.

With regard to Chau Pang, Mr. Hall Brulton submitted that no evidence had been given of "the

persons unknown." He quoted the ease of the Crown Thompson, in which three men were charged with conspiracy with persans unknown. No evidence was given as to who the perнonя known were, and twe of the defendants were acquitted. as a result of which the third man had also to be acquitted. Mr. Hal! Brutton submitted that this was a parallel ense,

"Charges Badly Framed." Another ground on which his application was based, went on Mr. Hall Brutton, was that the charges were badly framed. That was only a technical paint, but if the charges were badly drawn, the defendants could not be made 1o suffer for the mistaken of the Crown. The Crown must suffer for its own mistakes.

Referring to conspiracy. Mr. Hall Brution Fac conspiracy

could not have been proved if the two cases had been taken separate- ly as they should have been. To support a charge of conspiracy. there must be a criminal act, and Mr. Hall Brutton submitted that there was no criminal act committed by the constables. In the Hase of Contmats to- day, Captain Eden, answering Mr. (Nat. Liberal, Geoffrey Mander Wolverhampton E. said that the question of the non-fortification of Hongkong in the event of breaches of the Washington Treaty, and of the Pact of Paris being broken. was sub julier.
