DESCRIBED AS SUBTERFUGE BY MR. JENKIN.

JUDGMENT RESERVED.

The attempt by Shanghai- creditors of the Russo-Asintle Bank to obtain a preferential i share in the surplus assets in Hongkong, on the ground that they are privileged creditors, was described as the ninth at- tempt to get the assets into the hands of Chinese liquidators by the Full Mr. F. C. Jenkin, in Court of Appeal this morning. Sir Peter Grain was the Pre- sident, and with him were the Chief Justice (Sir Joseph Kemp) and the Puisne Judge (Mr. Justice Lindsell).

Mr. Jenkin described it as "sub terfuge" and stated that the ap plication was not a bout fide ane.

The appeal is against a judg ment delivered by the Chief Justice (Sir Joseph Kemp! In Chambers on May 8, this year, the appellaols being the Bank of Chosen, Bank of Taiwan, Merrane tile Bank of India, Australia and China, Mitsu Hishi Bank.
