As most of the ships had left hár- bour, the Navy was unable to send out their beat team in last night's water-polo first division

fixture against the Chinese Athletic seven, but although the game was most one Laided, the sailors put up a creditablo showing, in view of the circumstances. The final scores were eight-nil, but the Chinese wore by no means in their best shooting form and missed many casy chances from right in front The teams were:

JAPANESE IMITATORS.. The possession of goods bearing infringing trade marks was the subject of a summons by Mesars. Jebsen & Co. against the Kwong Yat On firm before Mr. Schofield at the Central Magistracy yester day afternoon. The proceedings concerned two cases of "Blumen Tolletto Saife," a brand of soap for which Messrs. Jobsen are the local agents, but which were imported from Japan and were seized in the Kowloon Maritime Customs shed, on the point of being convoyed by the Kowloon-Canton Railway to Canton.

Thursday, the Hongkong Cricket Club were well beaten, conceding the points at stake by 74 sols to 1%. Scores:

If those facts were found to bo true then there could not be "pos session" and the defendants had no case to answer.

Turning to the legal aspect of the case, Mr. Lo said the proof of possession was not enough: they had also to show that that "posses- sion" must be with the view to sale, trade or manufacture. He had shown that the defendants were do- ing this business of forwarding the goods without remuneration. They were doing this only as a friendly aet.

If defendants were guilty, then the Shipping Company, the Godown Company, and those others cerned in the handling of the goods were also guilty.

"Cross Fenud.” Replying. Mr. Armstrong ob- served that the infringement con- atituted one of the grossest pieces of commercial fraud he had the misfortune to see. They could ace how far the Japanese had gone and made of it the excellent imitation it was. Not only were the wrap pings and trade marks copied but the pamphlets inside were also ex- act reproductions. His clients felt that too much publicity could not be given to this case, whether these defendants were technically guilty or not.

Mr. Armstrong said: It seems to me that although the infringe- ments may reflect credit on the Japanese Imitators, the whole thing is grossly dishonest, and If these defendants escape on a technical point, we shall be pleased to obtain a curtain modleum of publicity.

Proceeding, Mr. Armstrong con tended that the onus was on-the- defendants lo show what the section required of them. He disagreed with Mr. Horace Lo regarding his definition of the wosition of the de fendants In the case as analogous to the shipping or godown com- panies, Mr. Armstrong stating that the latter were common forwarding agencies.
