The defendant said that he was a medicine hawker. The business was handed down from his grand- father. They dealt in plasters and nothing else. The plasters were manufactured by him in Reclama- tion Street. After he took over the business from his father, he did not effect any change in the wrapper used for the plaster. He never heard of the Yee Tin Tong Dispensary until two months ago. The plasters were distributed in Macao, Canton, Hongkong and other places.

Rendall, counsel for the complainant who is Kong Heung-po, of the Yeo Tin Tong dispensary, defendant ad.. mitted that his grandfather had not registered the trade mark, ner had he done so himself. When fronted with one of his own plasters, which had printed on It, that it was registered in the Gov- ernment, the defendant went back on his previous statement and ad- mitted that it was printed so but he had not registered the trade mark. Defendant denied that ha had copied the trade mark from that of the Yee Tin Tong diapen- sary.

The Hong Khong sailed from Hongkong on Wednesday evening for Singapore and at 235 a.m. yester day, according to the message, she came upon a small diamasted junk, riding to trawi. showed signs of distress and the Hong Kheng im- mediately made for
hoard it. On this junk were found three men, who were all in an exhausted condition. They were taken on board the long Kheng, pparently continued on its way to Singapore.
