"Is it not a fact that the carry- ing on of such an offensive trade in the premises mention- ed creates insanitary and un-i healthy conditions for shops and firms in the vicinity?" A. "There is no evidence, that these premises are in an, in- sanitary condition or

that A. they are prejudicial to per- sons living in the neighbour- hood. There is, however, a na-i tural presumption that the amenities of a district in which Offensive trades are permitted will be less than those of a district from which Q. such Trades are excluded." Q. "Is the Head of the Sanitary Department satisfied that the existing Offensive Trade Bye- laws are being strictly enforC- ed, and in particular that Bye-law No. 5 is being com- piled with by the occupiers of Nos. 27 to 39 North Street?" The answer to the first part of the question was "Yes" and to the second part, "I am satisfied that all reasonable steps are being taken to comply."

Q. "In view of the importance

of the question" of offensive trades in relation to public health, is the Head of the Sanitary Department satisfied

A.

that the present bye-laws are sufficiently up to date and efficient for the purpose of re- ducing the nuisance of offen-

aive trades to a minimum?" "The existing by-laws appear generally to be efficient for the purpose and notably so in the case under review. The need for satisfying my- self that they are up-to-date does not therefore appear to arise."

"In view of the fact that cer- tain remedies for counteract- ing such zuisances are sug- gested by various authorities on public health, eg, Robert- son and Porter in their work "Sanitary Law and Practice,"
