It was quite clear. however, that if a man either pur chased property in the name of his wife, or passed his own 'pre- perty into the name of his wife under the guise of an assignment from him to her, the law held
For some little time prior to the husband's crash, which occurr- ed during the atrike in 1925, he and two others were interested in Pedder Building and the Queen's Theatre. They drew lots among themselves and the casting result ed in the defendant becoming the sole owner of Pedder Building. For the purpose of putting up that building, he contracted a building mortgage with Jardine, Matheson that, as it was an advancement to and Co., for five`lakhs; a second mortgagee with another person for three lakhs, and a third with another person for $130.000, the total being $930,000. He was a man of substance up to the 1925 crisis.
Unfortunately, before the build- ing was up the strike took place. and the husband found himself in considerable financial difficulty. The first mortgagee exercised the power of sale and the property was sold for $850,000, which was
insufficient to satisfy the third mortgagee. In 1926 defendant en- tered into an arrangement with his creditors and paid them in full settlement 10 per cent. All this was very unfortunate and it resuited in a drop in the man's position among property owners,

On March 29th., 1930, a very foul assault was committed by the husband on the wife. The lady was at that time the owner of four properties. The first she had ac quired from a stranger and the other three from her husband. She was residing. at one of her pro- perties, 29 Old Bailey, with her children by the defendant. The husband had some years back taken to himself another woman as a concubine, and from that date he and the wife lived apart. But he occasionally visited his wife, On March 29th, in the early morning, from the conduct of her husband
