JUDGE'S COMMENT ON A

WITNESS DRESS.

the

Mr. Justice Wood took exception to the appearance of a police inter- preter dressed in shorts at Criminal Sessions yesterday after noon, and indicated that he wished witnesses to be properly dressed. Mr. Somerset "Fitzroy, Counsel for the Crown, said he would see to the

matter.

The above incident occurred dur- ing the trial of Wong Kam, who is charged on two counts in connexion with an alleged forged $100 bank note, purporting to be a note of the Chartered Bank of India, Australia and China. On the first count ag-

cused is charged with uttering it with intent to defraud at the Kum Toi Hotel, Nathan Road, Kowloon. The second count alleges that by means of the note he obtained $70 from Tam Kwai, sub-accountant at the hotel. Accused, who is not re- presented, denies both counts.

In setting forward the case for the Crown, Mr. Fitzroy, pointed out to the jury that they had to be satisfied that accused knew the note was a forgery before they could convict. It appeared that the note came into accused's pós- session on about May 13, 1930, and he took it to the hotel where he engaged a room. Apparently the accountant had not enough change so he gave $70 to accused who did not sleep in the room that night. He went to Hongkong and took a room at the Tung Fung boarding house where, he stayed the night.

Balance Paid.

On the following day he return- ed to the hotel where he received the balance of his change, $20.40, He went away but again returned the next day, In the meantime the note had been taken to the bank and found to be forged so that when accused went to the hotel he was approached by the accountant.

When asked about the note, he said he had been given, the note by a friend and told to engage a room for him at the Kum Toi Hotel. Accused was unable to find his friend, however, with the result that he was arrested.

When charged, accused said that he did not know the note was
