CHOPPER ATTACK.
MURDER CHARGE AGAINST SHOP COOLIE.

Details of how Tam Chap came to his death at the Sui Fung Tobacco factory. 345 Queen's Road West, on April 28 were related to Mr. Lindsell, at the Central Magistracy yesterday afternoon, when Fung Yan was charged with the murder of Tam Chap.
Mr. Murphy, Assistant Super- intendent of Police, prosecuted and the interests of the Sui Fung firm were watched by Mr. F. I d'Almada, junior.
In his outline, Mr. Murphy said that Tam Chap was a packer at the factory and had been em. ployed there since 1925. Accused, who had been connected with the firm for a similiar period, was a shop coolie,
About a week before April 28, Mr. Murphy said, accused seemed to have a delusion that his services at the factory would soon be terminated, but was assured by the other fokis at the factory and also by the manager that such a step was not contemplated.

"It is alleged," said Mr. Murphy, "that accused suddenly appeared from the kitchen armed with a chopper and attacked Tam Chap, who was squatting with his back towards accused. Three wounds were inflicted in his neck and head. Accused then ran up a passage and met another foki seated on a stool."
Cry of "Fire!"
It was further alleged that ac- cused attacked this man, and in- flicted one or two minor wounds, but the foki defended himself with the stool and succeeded in making the accused release his hold on chopper. Two other fokis then seized accused and held him for some time but released him when be (accused) called out "Fire." They noticed smoke coming from a rear room and found that it was coming from a bed quilt which had ap parently been smouldering for some time.
"It may be reasonable to sup- pose," said Mr. Murphy, "that ac- cused had it this fire himself."
In the confusion that followed, accused escaped down the stairs to the street and is alleged to have said, "Don't stop me. I want to kill the old man", apparently meaning the works manager, Mr.. Murphy added.

The next morning accused was seen standing outside the head of- fice of the firm at 237 Queen's Road West and he was arrested without a struggle.
"I was feeling not well. I cut him by mistake," accused was al- leged to have told the police, Mr.. Murphy concluded.
Doctor's Evidence.
Dr. G. H. Thomas, Medical Of- ficer at the Government Civil Hospital, who attended the injured men upon their admission into the Institution, stated that Tam Chap died the same day as the result of the wounds he received. Comment- ing on the terrible nature of these injuries, witness stated they ap- peared to have been inflicted from behind while the deceased was in a sitting or squatting position. The blows were struck from above and and were consistent downwards,
with the weapon produced in Court, As Medical Officer at the Gaol, witness mentioned that for 14 days he had been keeping the accused under medical observation.
Witness also referred to the case of the other injured man, whose condition, however, was not serious. The patient was discharged from Hospital two days after his ad- mission.
