EXECUTRIX CLAIMS.

A scheme for the formation of a new Company for the production of cinematograph films which did not come to fruition, owing the death of Mr. Lee Hysan on April ́-30, 1928, had a sequel in the Supreme

the Chief Justice (Sir Joseph Kemp) when an action was commenced by the executrix of the estate to recover an advance of $6.000. Plaintiff was Wong Lan-fong. No. 74, Kennedy Road, Hongkong who sued Lai Pak-hoi. No. 35, Lee Garden Street. She claimed, as executrix of the late Hysan's estate, the sum of $6,300 as money lent to defendant by the late Mr. Les Hysan.

In her statement of claim, plaintiff Suye that defendant formerly resided at No. 35, Lee Garden Street, but is now absent from the Colony and his where. about are unknown. Of the money de- claimed, $5,000 was paid to fendant on December 6, 1927, and $1,000 on January 12, 1928, for a -consideration which failed.

The statement continues that about the month of December, 1927; the late Mr. Lee Hysan pro- visionally arranged with defendant for the formation of a Company cinemato- for the production of graph films. Defendant was to provide certain apparatus. which the Company was to purchase for the price of $25,000 by the issue of shares. Defendant required an advance of $5,000 for the purpose of releasing the apparatus from a certain claim and the late Mr. Lee the Hysan accordingly advanced money for that purpose. The ap- paratus was delivered into the custody of the late Mr. Lee Hysan pending the formation of the pro- posed company.

Plaintiff's statement goes on to say that M, Lee Hysan died on April 30, 1928, whereby the scheme for the formation of the proposed Company came to end, the sum of $6,000 became payable by defendant to the estate of deceased and the apparatus be- came returnable by the estate to defendant.

was subsequently arranged between defendant and Mr. Lee Hylap, No. 82, Percival Street, de- ceased's brother, aeting on behalf of plaintiff, that the $6,000 should be repayable on demand and that pending payment the apparatus should be held as security.

Plaintiff states that she has de- manded repayment of the money and is ready and willing to re-de- liver the apparatus against such payment but defendant has failed to repay the money or any part of it.

Plaintiff claims (1) judgment against defendant for $6,000, (2) execution against the property, of defendant which has been attached under a writ of foreign attachment issued on April 7, 1930, (3) costs and (4) any other relief.

Shanghai, May 7: The simultaneous outbreak of hostilities between the Nation- alist and anti-Nationalist forces at Tangshan, Kweiteh, Pochow, in northern Anhui, and along the Lung-Hai Railway, are re ported from the Nationalist Headquarters at Hsuchow, lead- ing to the belief that the Kuo- minchun Army has decided to adopt the offensive along the Lung-Hai Railway, with chow as its first objective.
