Rome, Feb. 26. The death has occurred, after an operation, of Cardinal Raphael Merry del Val, the Secretary of the Holy Office at the Vatican. He
was 64 years of age, and had a
remarkable career.-Reuter.
He was a brother of the Spanish Ambassador in London-a post also held by his father-and was born in London.
As was only to be expected when ho grew

Mr. Potter went on to deal with Whitely's case which, he said, was applied by the Chief Justice. Counsel asked what power was there to or der payment of interest forthwith? At the most, interest could accrue, but he doubted if the other side could produce a single authority to the contrary. The only question in Whitely's case was from what date interest was due. The ordinary course of the law was applied, that interest accrued on what was, in that case, undoubtedly a legacy. from the date of testator's death.
Mr. Potter's Query.
Counsel, after pointing out the difference between Whitely's case and the present case, asked why should interest be payable forth- with or at all?.
