Before the proceedings resumed the Coroner, MT. Whyte Smith, and the jury, visited the scene of the accident where the mechanism of the engine was ex- plained.
The first witness called was the stoker mentioned by the driver on tho previous day. Witness stated that he had uncoupled the engine and, after giving the driver the signal, had walked towards the cab to regain his place on board prior to returning to the coal shed. The engine and travelled for a few feet when he heard a can dropped. On looking round he saw the deceased caught be tween the engine and the car. riage.
Witness stated, in reply to a question, that he did not.notice. the engine stop or move forward after lind reversed and moved away from the carringes.
Lever Movement.
Mr. James Smith, assistant me- chanical engineer of the Railway, was questioned with regard to the pusabilities of the lever which controls the movements of the en- gine, falling of its own accord and causing the engine to move forwards when it was travelling in reverad.
The Coroner naked: Do you think it is possible, when the en- gine driver was driving out from the carriages, that the lever sud- denly fell of its own weight' and the engine reversed?
Witness: I have never known of an occasion.
Now, the engine driver days that the lover was loose and that he had reported it before. If it were loose might that happen?—! No, your Worship.
Now supposing the engine were at rest a few feet from the car- riages and the driver wished to move away from the carriages, is It possible that it might go back A little-Yes. He might want to go back if he finds himself on the "dead centre."
The least thing, I suppose,
would do? Go back a foot or two Anything? Yes.
No Negligence.
しい
With the aid of a model witness explained what had apparently happened. He said after the stoker had signalled the driver, the engine had been moved back- warda slightly, and then stopped.j to enable the stoker to get on board. Then the driver, Anding himself on "dead centre," had un- consciously moved forwards be- fore reversing, but had moved forward aufficiently 10 have caught the deceased.
Before addressing the jury the Coroner expressed thanks to Mr. Smith and Mr, I: B. Trevor for the trouble they had taken in ex- plaining the mechaniam of the engine. Ha thought it could not have been made more olear by anyone else.
TALKING SINGING
The Coroner reviewed the evi- dence, laying stress. on the ex planation suggested by Mr. Smith '87, who had stated that the driver apparently had moved forwards towards the carriages when he had found the engine on "dead centre." The jury was asked to state whether the accident was the result of negligence and if so whose negligence, as well as to say if there was negligence if that negligence amounted to groas negligence.
Without retiring the jury in! timated that they found there was no negligence in the case, verdict of donth by misadventure being recorded,
