The soquel was a complaint to the Managing Committee and the decision of the Committee to ex- clude the plaintiff. Subsequently the Committee were advised that the decision was ineffectual, and they decided to rehear the case.
Mr. Archer, K.C., for the Major, said that the Committee had since passed a resolution suspending the Majer until January 31 from the use of the club. They said that their previous decision of partial suspension was invalid. In the meantime it was quite impossible! for the Major to continue his at- titude of being at liberty to attend the club, He (counsel) thought the best thing would be to unk that there should be no order on the motion except that the costs should be costs in the action, and that the Major be at liberty to bring another action if necessary.
Mr. Justice Farwell said he thought the proper order would
be,
no order on the motion ex- cept that the costs be reserved, and he made his order accordingly.
