Arrangements are now well In hand for the St. Andrew's Ball, to be held at the Peninsula Hotel on Friday night. The last of the practice dances was held last oven- ing.. being attended by a large gathering, who spent a thoroughly enjoyable time.

Glowing tributes were this mor- ning paid to the work of the Tung Wah Hospital by His Excellency the Governor when he performed the opening ceremony of the new "eastern branch hospital, situato at

Sookunpoo.

His Excellency spoke of the charitable administration under-ing ceremony, taken by the Hospital, which, he said, commanded the respect and confidence not only of the Chinese of this Colony but of those in China itself as well as oversens.

Without the constant and ready assistance of the Directors of the Hospital, said His Excellency, the task of the liongkong Government would be infinitely more dimenit and the result of is activities much less satisfactory both to itself and to the community in general.

His Excellent stressed the need of an adequate Endowment Fund, in the raiding of which he hoped that not on the Chinese com munity, but the European com munity as well, would make special effec :.

The plaintiff, here repudiates the arrangement made by his agent with the defendants, though, so far, he has not repudiated the, parällel arrangement made by the

The defendant, in my opinion, is here unable to set up any express authority in the landlord's agent to terminate his contract of tenancy. Nor can the termination of д tenancy be held to be incidental to the ordinary course of a rent col- lector's proceedings or to come within the apparent scope of any general authority given to, a rent collector. In the present case, how ever, the plaintiff seems to me to be estopped from denying the authori- ty of his agent to complete these negotiations with his tenant. Hay Ing received his agent's report on August 0, on discussions conducted with his tenants, he still maintain- ed the same agent in a position to continue these discussions, without appointing another specially authorised agent to represent him in the distraint proceedings.

The defendant believed the agent to have the required authority to bind the landlord as he purported to do and that he so believed ia to be attributed to the fact that the game agent had been used, seven inys previously, to the knowledge. of both parties, as a channel of communication in a dispute between them which concerned matters, strictly speaking, outside a rent collector's province, and which was still outstanding.
