A young boy was brought up be fore the Court upon the suspicion that he had been smuggling oplum. After they had partaken of a meal, Chan sat on the port side of the stern sheet and his feet were not actually outside the boat. Accused denied that he squatted down behind Chan as Lee Fat, had said he did. He sat on the star- board side. Accused said he could not say whether Chan was likely to lose his balance. He (ac- cused) was not angry with Chan' and he would not have been angry even if Chan had struck him.

Accused continued that he wanted to get some tea which was" in the hold, but in order to reach the hold he had to pass Chan. Às he was obstructing the entrance to the hold, accused pushed Chun slightly outwards, with the result Con-that he fell into the sea. Accused

Empty Cars.

When he asked the Chinese drivers to take him to his destina- He tion they shook their heads. knew of no reason why they should have refused to take him, as the cars were empty at the time, He had always paid them liberally.

Sergeant Roberts said that that particular day was a Chinese Fe- tival and the, motor drivers were charging $6 to the Peak, whilst the fare to Taikoo was only $1.20. The Indian defendant said that Mr. Brayfield was 4 nephew of a man who owed him $25. He pro- duced a chit to that effect.

Mr. Brayfield replied that he had no relatives in Hongkong.

One of the Chinese said that he refused because he had already been engaged by the N.Y.K.

The Indian added that he was engaged for 2.30 p.m. which was five minutes before Mr. Brayfield required him. He had two wit nesses to support him.

Two Chinese then came forward, but in their evidence they said they engaged the cars for 2 p.m. and as they were not there when required, other cars were engaged,

Story Not Believed.

Mr. Hamilton said the whole case was as plain as a pike-staff, and the evidence of the two Chinese witnesses convicted, the defendants. He refused to be- Heve that they were engaged five minutes before Mr. Brayfield re- quested their services. He was satisfied that they refused Mr. Brayfield because they thought i they might get a bigger fare. He would convict them.
