CHINESE ACTION RESENTED BY ESTATE COUNCIL.

NANKING APPROACHED

Further developments have occurred in the attempt to bring Kuling under the control of the Lushab. administration.

The Kuling Estate Council is once again bringing the irregular action of Chinese officials to the attention of the Central Govern- ment at Nanking and the Consular representatives of the nationa involved. Correspondence' which has taken place between the Estate Council and the Mayor of Riu- klang is given below,

On June 26th, the Kuling Estate Council issued an official Statement containing a brief historical ac- count of the purchase and develop ment of the Kuling Estate, in re- pudiation of the claim posted or a notice.within the Estate boundaries by the Mayor of Klukiang, stating erroneously.. that "Kuling and Luling have now come under the direct control of the Lushan Ad- ministration, and are not as former ly governed by foreigners in the cffices established by themselves," and thut "the taxes made by Chinese and foreign residents will be paid to the Municipal Govern ment of Kiukiang."

Since that date correspondence has continued, and the Council now desires to make public, letters which bear on the subject of the Control of the Estate.

Kiukiang, August 21st, 1929..

"From the meeting that was presided over by me at Hu Ching Fang's Chapel at Kuling yester- day forenoon, Mr. Chow Kuong Hung, Commissioner of Con- struction, told uy that Kiangsi Provincial Government Com- mittee has taken progressive step toward the advancement of Kuling, Luling and Lushan as a whole and that the residents at Kuling, both foreign and Chinese, must knead together as one lump whole, while any former organisa- tion or Company-like system must give way to the new Tsang-sze- huei and that the paying of taxey to the Provincial Govern- ment by both foreign and Chi- neso' residents must be equal in proportion to the amount of land and the value of the house each land-holder has. For this reason I hope that the land-holders at Kuling will get their representa- tives ready to take part in our Tsang-sze-huej. or Counsellors' Meeting which is to be formed in a few months.

"All members of the Estate' Council were individually invited to attend the meeting, but some members were unable to be pre- sent. Mesara. Matson, Kemp and Craighill in addition to Mr. J. L. Duff were requested to attend the meeting, and report proceedings to the Council. They were given no authority to negotiate or to make any statement on behalf of the Council.

The meeting was opened by Mr. C. S. Wood, Mayor of Ki- kiang, who introduced Mr. Cheo Kuong Hung, the Commissioner of Construction of the Klangsi Provincial Government. Mr. Cheo reported that the Kiangsi Provincial Government had lately made Lushan & Special District directly under the control of the Commissioner, "of Construction,' the Commissioner of Finance, and the Commissioner of Civil Affairs of the Province and not under the Municipal Government. of Kluking as before; and that this action had been sanctioned by the Central Government. 26th August, 1929. "We are in receipt of your letter of the 21st inst. giving further particulars of the pro- posal of the Kiangai Provincial Government which you before stated has been sanctioned by the Central Government, and the matter has had our careful and sympathetic consideration.

We have always been willing to co-operate in any reasonable "scheme for promoting the public -affairs of the Lushan District, as was also expressed in the recent public meeting. of which you were chairman. There is, how- ever, some ambiguity in the pro-

that the Kuling Estate was ob tained from the Chinese Govern- ment by purchase, and is held by the Kuling Council under a Government deed in perpetuity, which is registered in the Bri tish Consulate at Kiukiang, and the whole Estate, including the roads (excepting Four roads named in the deed) is the pro perty of the Kuling Council, who have issued sub-leases, termin- able in 999 years, to the various Lot-holders

To attempt to dissolve the Kuling Estate "System" without regard to the Council's rights under their deed, would be an illegal procedure, which we trust the Chinese Government would not wish to take.

In our opinion, the only way in which the desired object could be legally attained, is by re-pur chase from the Kuling Council by the Chinese Government of the Whole Estate, subject to the existing leases and trusts which the Council has exccuted, but such a proposal would require tho sanction of the Annual Meeting of Kuling Landrenters.

We shall be pleased to receive the views of your Government on this matter...

Referring to your proposal as presented, we would make the fllowing comments:-

1. You do not bring forward any Constitution or Charter under which your proposed organisation is to operate.

2. You do not define the limits

of the Special District which you propose to organise into one.

3. What is the basis of the election of representatives by Landholders?

4.
