COMPLAINT OF CHOCOLATE ADVERTISEMENT,

London, July 16. A common jury yesterday award. ed Mr. Cyril Tolley, the golfer, $1,000 damages in an action for libel which he brought against Messrs. J. S. Fry and Son. Thin subject of the "action was. an advertisement announcing the "cartets" sold by Mesars. Fry, and the alleged libel Wat con- tho Lained in a caricature and following Limerick:

My word how it files. Like a cartet of Fry's, They're handly, they're good, and priced low sir."

This was published in the Daily Sketch and the Daily Mail in June last year.

Mr. Goddard, for Mr. Tolley.. maid that the "caricatura was published without Mr. Tolley's consent. It was A scurrilous attack on his amateur position, for reasonable people would say: "Cyril Tolley is lending himself to an advertising stunt for chocolate. I wonder what he gets

out of it?"

Mr. Tolley had no objection to being caricatured in connexion with sport, but he objected to appearing in a chocolate advertise- ment,

Mr. Tolley, in evidence, said that he had no idea that the caricature was being prepared or was going to be used. An imputation on a golfer's status would be detri mental in that it might prevent him playing in the amateur cham- planship. It would definitely be a very bad thing for any well-known amateur golfer to lend himself to an advertising campaign. either for money or other return.

Mr. Birkett (for the defonce)-~~ I gather that your real complaint is that people might think you were receiving payment from Messrs. Fry for allowing your caricature to appear?-I can sec no other construction to be put upon a thing like that. I cartooned so much that people would say: Why should I sud- denly appear for Frys unless I get something out of it? ̧

Mr. Birkett put the hypothetical case of a Cabinet Minister nppear- ing in a cartoon, and asked: "Would you still think he must have received payment?"

"He is in a different position," said Mr. Tolley. "Cabinet Minis- ters are professionals. My pro-† fession is not paying golf; it is

on the Stock Exchange, and oue of the rules is that you must not advertise. Cabinet Ministers and people like that advertise as much

as they can."

Mr. Norman Birkett-Do they? Counsel suggested that Mr. Tolley, being a public figure, must expect to be utilised by cartoonisis.

Mr. Tolley-I don't expect it but I have to put up with it. (Laughter). The cartoon rather indicates that I go round and chew chocolate.

Mr. Edward Prangia Storey, who has played for England against Scotland and America, said that on seeing the curloon a great mahy people would think that Mr. Tolley was not preserving his amateur status.

A similar view was expressed by Mr. Henry Oberton Hobson, secre tary of Le Touquet Golf Club

This concluded Mr. Talley's ense.

Mr. Birkett intimated that he did not propose to call any evid--

ence.

The jury, after an absence of a quarter of an hour, returned a
