The point arose during a case in which a Chinese, was charged of with larceny of 28 pounds brazing solder from the Kowloon Docks and with escaping from legal custody after having been arrested by a watchman of Dacks.
His Worship pointed out that the section under which he was charged mentioned police officers and warders, and he beld that the defendant was not in legal custody, when he escaped.
On the charge of tarreny the defendant was sentenced to six months hard labpar, a previous į gonviction for larceny being pro- dneed. On the second charge the defendant was acquitted,
