INCIDENT AT FERRY.

INDIAN CONSTABLE AND BUS EMPLOYEES.

Three employees of the Kow- loon Motor Bus Company charged before Mr. T. S. Whyte Smith at the Kowloon Magistracy Yesterday on counts arising out. of an incident which took place at the Star Forry Wharf on the afternoon of April 3.

The first defendant, a conduc- tor, was charged with soliciting passengers, while the others, regulator. and an inspector, were alleged to have obstructed an In- dian constable in the execution of his duty.

Mr. L. II. C. Calthrop prosecut- ed on behalf of the Police, and Mr. D. L. Strellett represented the three defendants.

Mr. Strellett made au applicn- tion for a summons fer assault to be taken out against the com- plainant by the Arst lefendant, and suggested, that, as the facts were the same as those which he would call for the defence in the original charge, his Worship, sub. jeet to the approval of the pro- secution, should take the cross summons at the aame time.

Mr. Culthrop greed, and open- Ing his case, said that at 4,45 p.m. on April 3, an Indian constable was on duty at the Star Ferry traffic post.

While on duty the constable noticed a bus conductor (the first defendant), soliciting passengers, calling out "Shamshulpo and Lai- chikok Road." He was told to stop, but as soon as the constable had returned to his post again the conductor recommenced his shouting. The constable went to the' Arst defendant and asked for his number.

Instead of giving his number the defendant ran into the bus with the constable Int Durauit. After running round, the vehicle unce the conductor was caught by the constable. The traffic regula tor (second defendant) then or dered the bus to move on. The driver accordingly started the hus, which was going to Kowloon City.

Alleged Assault.

The constable had made up his mind to charge the conductor, and when the bus had gone as far as the Water Police Station ho order- ed the driver to atop. He got out of the bus, and proceeded to take the first defendant. Lo the Station.

Jn the bus at the time were the; regulator and the inspector (third defendant) who followed the party up the incline. The first défendunt tried to escape, and the inspector caught hold of the conatable while the regulator snatched the baton from the policeman and struck him with it. The party then went to the Sta- tion.

Mr. Strellett put it to witness that he boarded the first defen- dant's bus at Public Square Street at 3.30 p.m., but witness said that the bus he boarded went via. Canton Rond and not by Na- than Road. Witness further denied that the defendant's bus stopped at the Majestie Theatre, and that he had had some words with the conductor.

Ferry Official Called. After taking further evidence, Mr. Strellett asked permission to call Mr. J. W. Beatty, frat. Mr. Beatty and that the ten minute Barvica of the Star Ferry ter- minated at 4.30 every week-day, and at 4.40 the spare ferry which made up the fourth for the five minute service departed from Kowloon.

Mr. Strellett outlined his caso, and pointed out to his Worship that unless the complainant had trayalled on the first defendant's hus the conductor'could not have known of the constable's. move- ments that afternoon. Mr. Strel- lett suggested that the constablo had gone up to the wrong' bus. When he had gone up to the de- fendant he kicked him in the back. and when the conductor ran be was chased.

It was pointed out that the do fendant had no object in calling out "Latchikok Road and Sham- shuipe."
