There must, therefore, be some little risk in the car passing the truck on the right-hand side, al- though as they knew, the rule of the rond was for one vehicle to overtake another on the right- hand side. The driver's evidence was corroborated by that of the two passengers, and perhaps on the whole it was not a very serious offence under the circumstances.

Proceeding, his Worship dealt with the substance of the two' al- ternative findings, adding that the jury were to return a verdict of Death by Misadventure if they could not find that the death of the coolie was due to criminal negl-
