RECOMMENDATION TO MERCY BY JURY.

DEATH SENTENCE.

At the Criminal Sessions, thin morning, Sandagar Singh was found guilty of the murder of Jett's Singh at Lalchikok on February 18th, but was recommended to mercy, Mr. Justice Wood, in pass Ing sentence of death, expressed his agreement with the verdict and said no doubt the fact that the prisoner was drunk had led the jury to make a recommendation to

mercy

The prisoner heard the sentonce Impassively.

In addressing the jury this morning, Mr. Somerset Fitzroy, who prosecuted for the Crown, anid it had been proved that Jetta Singh had been set upon and struck down by some sharp, heavy Instru- ment, and evidence had been called to show that the weapon was in all probability an axe.

So far as the evidence for the Crown went, there was no mention of any quarrel between the men, but he would ask the jury to say that it was a deliberate attempt on the life of Jetta Singh The evid- enco made it clear that it was a case. of murder.

That was the only evi- dence of any quarrel between two semi-drunken men.

Counsel asked the jury to say that the prisoner took the chopper, which was missed from the kitchen, and had not been found,

Mr. Thomas Tam, for the de fence, in explaining why the pri- soner had not gone into the witness box, reminded the jury that when charged the prisoner said "I was drunk and know nothing about it." It was difficult to get evidence out of a man who was in a condition When he was drunk and could not remember anything. If a man, in such circumstances, was subjected to a severe cross-examination, he might Huy something which would prejudice him.
