"Considerable argument arose at the Central Magistracy this morning, when, before Mr. R. E Lindsell, Mr. Horace Lo, defending a summons against the driver, of a private ear, argued, that the summons was bad because it did not conform with the Summary Offences Ordinance. Sub-Inspec- tor C. F. Alexander and Sergt. A L Hopkins prosecuted.
The summons was taken- out against the driver of private car No. 2299, no name being given. under Sub-Section 12 of Section 3, for unnecessarily blowing his horn In a manner calculated to annoy.
Mr. Lo quoted, authorities in support of his argument that the summons was bad and his argu- iments drew from Mr. Lindsell the remark that if he made a rulingN in favour of Mr. Lo, It would mean to say that thousands of other summonses previously dealt with "were also bad.
Mr. Lo said he was quite pro pared to go as far as that.
Commenting on the Section un der which the summons was tak.n out, hia Worship remarked that. when it was drawn, motor car horns were not anticipated and it did not apply. It was obviously only for noises which might be caused by such things as peny trumpets or tin whistles,
Sub-Inspector Alexander replied that there was no other provision in the traffic regulations. He added: "It means that at the present time we cannot take actio against drivers who make a nolie to the annoyance of the public."

The summons was adjourned f. a week for Mr. Lindsell's decision on the point as to whether summons is good or bad.
